Ken bastida has the night off. Im elizabeth cook. Juliette goodrich says this is the first of its kind lawsuit against bart because it involves the first bart officer killed in the line of duty. Reporter thats right. The familys attorneys filed the lawsuit in court. It is a typical legal document. But in an unusual move, the officers wife also wrote bart a personal letter. She says her husband told her years ago what to do if anything like this ever happened to him. Kelly smith was an officer at bart for almost 20 years when her husband detective tommy smith was killed in the line of duty.
