A family court is not bound by the technicalities of CPC and is also empowered to take into evidence any material whether or not such material fulfills the Indian Evidence Act, held the Punjab and Haryana High Court.
The Punjab and Haryana High Court imposed costs of ₹25,000 on the Central government on finding that the government had effectively re-agitated an issue of law that had already been settled earlier by the Supreme Court.
Irrespective of extreme allegations made by warring parents against each other, courts must consider the welfare of the minor child and not the statutory rights of the parents, the Court said.
