pete, the fact that he did not kill anybody, and the fact that all the injuries are lower body injuries and everybody survived, is that going to factor into the charging? i don t think so. i mean, the fact that nobody was killed, fortunately, is the reason why the charges aren t more serious, but in terms of the statute, it doesn t matter. once he started opening fire then he qualified for this enhancement, so it really that part really doesn t matter. it raises the question, i think anybody would ask is why did he set off the smoke? what was the point of that? was it to obscure he was doing the shooting? it s all very strange. very strange, indeed. joining me in the studio is doug burns, the former federal prosecutor in the criminal eastern division of new york, which is the district that brought the charges against mr. james. tell us what is going on right now? basically the complaint is
