San Antonio oilman Brian Alfaro, convicted last year of defrauding investors in the sale of units in oil and gas wells, has appealed his 121-month prison sentence.
Alfaro, 52, also wants a federal appeals court to set aside an order directing him to pay about $9.9 million in restitution to 425 victims. He is not seeking to overturn his conviction.
The appeal was filed Monday with the 5th U.S. Circuit Court of Appeals in New Orleans by San Antonio attorney Michael McCrum, who defended Alfaro during his trial last year.

SAN ANTONIO – Luxury items seized by federal authorities will be auctioned off this Saturday as part of a restitution order, officials say.
In February of 2020, Brian Alfaro, formerly the owner of Primera Energy LLC, was convicted on seven counts of mail fraud.
According to authorities, Alfaro offered people the opportunity to invest in numerous oil and gas prospects, including the Screaming Eagle 4H Prospect in Gonzales County, Screaming Eagle 6H Prospect in Gonzales County and Black Hawk Horizontal Buda #1 Prospect.
