Highways England has been referred to the Crown Prosecution Service (CPS) by a coroner to consider if manslaughter charges are appropriate over an M1 death near Derbyshire.
Grandmother Nargis Begum, 62, from Sheffield, died on a stretch of the M1 without a hard shoulder near Chesterfield close to Woodhall Services, in September 2018.
She had exited a broken down Nissan Qashqai car and was waiting for help when another vehicle collided with the Nissan, causing it to plough into her.

A coroner investigating the death of a woman on a smart motorway has asked the Crown Prosecution Service (CPS) to consider whether corporate manslaughter charges are appropriate.

Faster rollout of SVD tools has been promised by the Department for Transport, which is bringing the programme forward by several years.
AA President Edmund King has called for more “emergency laybys” and new radar technology to track incidents.
He said: This is a significant moment for ‘smart’ motorways and highlights many failings, previously raised by the AA, that should have been spotted before the first fatalities, and clearly need urgent action.
“The coroner feels there are significant concerns in this case which require further investigation.
Just eight people are monitoring the 450 smart motorway cameras within the Yorkshire and North East region, a court has heard.
The AA president Edmund King today stated the risk of death on the new stretches of motorway would be reduced with more emergency laybys and questioned the risk of having only eight people watching the cameras in the North East.
It comes as Highways England was today referred to the Crown Prosecution Service where it could face manslaughter charges for the death of Nargis Begum, 62, on a so-called smart motorway .
The grandmother-of-nine died when another car smashed into her stationary Nissan Qashqai at 90mph , according to one witness, after it broke down on a section of the M1 with no hard shoulder.
