parents in are outraged after a law was struck down, jessica s law was passed in 2005 and prohibited sex offenders from living less than 2000 feet from a playground or a school. polly franks is an advocate and mother of two survivors of sexual abuse and mark herald is an attorney and former policeman and join us for a fair and balanced debate. good morning. mark, i want to start with you. so, under jessica s law, sex offenders couldn t live within 2000 feet of a park, a playground or a school. that sounds logical, but the judge didn t like it and you don t like that either. why? well, i understand why people are outraged, but the reason, it s not that i don t leak it, wish we could achieve
that. the problem is it s not workable public policy. even in the old law, if you have a crime against a child, you could you have special provisions and you may have to live that far from a school or a church. under jessica s law it s all sex offenders and it s turned out to be a nightmare for law enforcement and no way to get the folks to live. one thing you don t want, homeless sex offenders, i understand why people are outraged and people want to achieve this. it s not workable public policy and why they violated the constitution. polly, your response? i would disagree as strongly as i possibly can. the people of california voted for this overwhelmingly, are we going to be, we the people or are we going to be we the judges? basically what the judge said and what i think police officers have said, it drives up homelessness. do you agree with that complaint? it may. you know, my problem is, i m more concerned with the safety of these children, we need
