The officer was not injured but Bossy was taken to the hospital with a non-life-threatening gunshot wound.
Oregon State Police conducted the investigation and the Polk County District Attorney’s Office presented evidence to the grand jury.
The grand jury heard from Oregon State Police detectives, the involved officers from the Salem Police Department, a Polk County Sheriff’s Office deputy and one witness.
After hearing testimony, the Grand Jury returned a not true bill, meaning they determined Hernandez s use of deadly force was justified and no criminal prosecution against the officer was warranted.
Hernandez has been an officer at the Salem Police Department since 2008.
