Justice Urmila Joshi-Phalke noted that the 13-year-old minor girl had said that she had left home on her own, that the accused man was of a tender age (26 years) and that there was little progress in the trial.
The Court said the power to arrest is a dangerous one as it encroaches on the most precious right of an individual i.e. personal liberty. It said the police must exercise this power with due care and circumspection.
