violent insurrection but putting definitional questions aside, the important thing about rhetoric from cruz and other republicans when they engage is to draw a line between what is and is not acceptable in political conflict. what happened on january 6th was a mass mobilize violent attack. five police officers died in the following days and weeks. 150 officers were injured with some sustaining brain injuries. one being stabbed with a metal fence stake. it was one of the worst days for injuries for law enforcement since september 11th. there was also an attempted pipe bombing at the headquarters of the democratic and republican national committees. a year later, no one has been apprehended in relation to the bombs. we found out vice president harris was inside the headquarters on january 6th when the pipe bomb was discovered outside the building. what would you call someone
general rate leads. breaking news just in. capitol police announcing they concluded and recommending action against six officers mostly for conduct unbecoming. joining me now law enforcement analyst jim kavanaugh. how concerned should we be that authorities have yet to identify the pipe bombing suspect? we should be concerned because the authorities are concerned. feb, atf, the capitol police, d.c. police. they released that information this week. the bomber could be emboldened that they weren t caught and don t know if that bomber is just a delivery person or the actual bombmaker. the bombs did not detonate so they might have had some problems in the fusing and firing system. we don t know if this is a man or a woman. if they acted alone or in concert but we do know they
charge. and that s a big problem because it could create a sort of federal loophole. we have federal laws that are applicable to many types of mass attacks. we have hate crime laws that make it a federal crime to commit an attack because of somebody s race religion, national origin. we have explosives charges. we saw those in the pipe bombing cases and foreign terrorism laws that make it a crime to commit acts in connection with foreign terrorist groups, electric willi al qaeda, isis. it would not be a federal crime in someone committed a crime because of political reasons but did not seek to terrorize that did not use explosives. federal laws carry a heavier penalty and the federal prosecutors need a way to prosecute all of these mass attacks. domestic terrorism can really fill that hole. elie honig, thanks for breaking that down for us. coming up, why the words of

and what has the president been doing? he s been president for two years and still pushing the anger and division. this may work in the senate map, but i think it s motivating the voters to come out in big numbers. by the way, i want to put up some numbers. we did ask in our nbc wall street journal poll how did the president handle the pipe bombing and synagogue shooting and he was under water in both instances, steve. we ve heard this from some republicans as they lay the ground work to try to explain what happened in the last ten day, they believe that whatever kavanaugh effect had been helping them, that the pipe bombs and the president s handling of it may have taken ahold. there is a thelry that donald trump reaches a point where he does this sort of ultimate trump thing where it s very polarizing and that does sort of galvanize his base, but it also requires this second piece where he
