Cleaned out instead of 390 inmates on death row, he says, we now have zero. You a Supreme Court says florida system of sentencing inmates to death row, to death, violates the 6th amendment. Florida allows a jury to recommend the Death Penalty but a judge actually sentences the inmate that is not constitutional according to 8 justices with one dissenting on that opinion. According to judge perry, that means floridas Supreme Court would have to make what is determination in all 390 of these cases. He says that is a very high bar for the state of florida to reach to execute any of the inmates that are currently on death row. You add to that some of these inmates will likely be eligible for parole on the florida law. And not that they get parole, but technically, they would be eligible.
