Those misconceptions extend to the issue of domestic terrorism.
“I understand that that can be confusing for people,” Hale said. “There’s not a domestic terrorism statute and that also makes it sometimes difficult to understand.”
Domestic terrorism legislation
Congress has introduced legislation to create a criminal statute for domestic terrorism, though none have been signed into law.
In 2019, U.S. Rep. Adam Schiff, D-California, introduced the Confronting the Threat of Domestic Terrorism Act, which would apply some legal penalties connected to international terrorism to domestic crimes if committed in a manner consistent with the federal domestic terrorism definition.
The American Civil Liberties Union opposed the legislation, which was referred to the House Judiciary Committee, with the concern it could be used to target people of color and marginalized communities. Op-eds in the Washington Post and New York Times also pushed back on Schiff’s legislation,
