A Saratoga Springs man who was working as a Lyft driver has pleaded guilty to aggravated vehicular assault for a Nov. 15, 2020 hit-and-run that seriously injured a 72-year-old jogger.
Patrick F. Phelan, 53, pleaded guilty on Thursday and is expected to be sentenced to three to nine years in state prison when he next appears before Saratoga County Court Judge James A. Murphy III on June 24, according to District Attorney Karen A. Heggen’s office. He will also have his driver’s license revoked.
Phelan has admitted he was driving intoxicated when he hit Andrew Fincke, who was jogging on the shoulder of Ballston Avenue in the city. Heggen’s office said the plea also included an acknowledgment that his conduct endangered the life of a young female passenger in the back seat, whom he was driving to work after she had hired him through the Lyft ride-hailing app.

BALLSTON SPA - A Saratoga Springs man admitted he was driving drunk during his ride-sharing shift when he struck a 72-year man jogging in the shoulder of Ballston Avenue in the city of Saratoga Springs, Saratoga County District Attorney Karen A. Heggen s office said Thursday.
Patrick F. Phelan, 53, pleaded guilty Thursday to the top count of the indictment against him, felony aggravated vehicular assault and misdemeanor reckless endangerment before Judge James A. Murphy III, according to Heggen.
The collision happened Nov. 15, 2020 when Phelan s car struck and seriously injured Andrew Fincke. Phelan s plea also included his admission that his actions in November endangered the life of a young woman passenger in the backseat of his vehicle, whom he was driving to work via the Lyft ride sharing company.

SARATOGA SPRINGS - A 72-year-old jogger was seriously injured on Sunday morning after a drunk driver allegedly slammed into him with his vehicle and then fled the scene, Saratoga Springs police said.
Andrew Fincke was jogging on Ballston Avenue at 9 a.m. when Patrick F. Phelan, 53, of Saratoga Springs crashed into him with his 2019 Jeep Renegade. Witnesses at the scene identified the vehicle that was later stopped on Broadway, police said.
Phelan was charged with felony assault, aggravated driving while intoxicated, leaving the scene of an accident, refusal to take a breath test, among other charges.
