enroached in the idea pardoning flynn. would you have enough to get that prosecution? well, here is what i will tell you katy. obstruction is always a fascinating investigation. once you have an actual act that you think may have been the act of obstruction, the question then becomes what was the intent behind that act. that s something that could be hard to prove. in this case as you just recited so many statements, so many additional acts, clear desire, i could not possibly count how many times. clearly indicated his take for this investigation. he demeans it consistently and he attacks the investigators themselves personally. he does not want this case to go forward.
hard a tell, it might be the conversation we ve been having about criminalization of african-americans and the role police officers have been playing in killing people in unjustified shootings. those headlines every time kill me, every time. jonathan? i interviewed senator doug jones for my podcast at the post and it s the one-year anniversary of his election. he s a former federal prosecutor and i asked him with the mueller investigation and the talk about the possibility of the president pardoning flynn or cohen or anyone, he issued a good reminder, a pardon only gets you so far. once you have the pardon, mueller could still compel them to testify. they no longer have the right to waive their fifth amendment invoke the fifth amendment. you can t use them. if you don t testify you could go to jail. if you lie you are still you could be held for perjury. so part of me is like, go ahead,
constitution that would prevent trump from pardoning flynn and manafort, the part that says that trump has to faithfully execute the office of the president. those are protections against self-dealing. if trump uses the pardon to get co-conspirators off the hook so they don t have to cooperate in a prosecution, that would be a faithless use of the pardon power against the public interest. analysts say if president trump does pardon michael flynn, paul manafort, michael cohen or others, this could bring them political heat later on. they say those people would be free for legal jeopardy, but harder for them to plead the fifth. harder for them not to spill what they know about the president s dealings if they re hauled before congress for impeachment proceedings or other investigations. wolf? so if the president decides to pardon manafort or flynn, is there anyone who would have the power to stop him? there could be, wolf. a prosecutor could actually go to a judge and say to the
