The man who was jailed for life for the murder of Waterford pensioner Paddy Lyons, has told the Court of Appeal that there is no proof that he caused the injury that led to the 90 year old’s death.
Ross Outram (30) from Ferryland, Waterford Road, Clonmel in Co Tipperary, was found guilty in 2019 by a Central Criminal Court jury of murdering Mr Lyons at Loughleagh, Ballysaggart, Lismore, Co Waterford, at a time unknown between February 23 and 26, 2017.
According to a report in today’s Irish Independent newspaper, Outram’s lawyer Michael O’Higgins SC said that while his client struck Mr Lyons repeatedly on the head, the pathology evidence showed that the victim died due to a hip fracture.

Blood was visible on the ground at the crime scene on Thursday while a bloodstained Canada Goose jacket was taken away for examination by members of the Garda Technical Bureau.

The injured teenager, who lives in another part of Dublin 8, less than 1km from where he was shot, was getting into a taxi on Eugene St just before 11pm on Wednesday when his attackers appeared and fired at him. The driver of the taxi and local people raised the alarm, with paramedics arriving to the scene within minutes.

Emergency services attended the scene and tried to revive the man, named locally as Paddy Lyons, but he was pronounced dead a short time later.
It is understood the victim, aged in his 40s, is regarded as a relatively low-level criminal.
Cops are probing if the murder is linked to an ongoing criminal dispute in the Ballymun area.
Over the last two years, there have been a number of incidents linked to rival gangs including shootings, assaults and intimidation. TENSIONS
A source said: “There have been tensions in the past among gangs operating in the Ballymun area and it’s a question of trying to establish why this individual may have been targeted.
