coming out of the altamont pass. we ll have more details on that plus ace train delays, as well. back to you. thank you. it is 6:01 now. more accusation of police misconduct in san francisco. another video has surfaced that appears to show officers entering an apartment without consent. anne makovec reports it was enough to convince a judge to dismiss a criminal case. she joins us now live. anne, good morning. reporter: good morning. yeah, the judge threw out a felony case. it was a marijuana case, granted, and the man did have a medical marijuana card. but there are concerns now that this new video, this whole case, could show a broader spectrum of police misconduct here in san francisco. the judge tossed out that felony drug case after seeing this video. it s from security cameras of the local apartment building. these are the officers in the garage and in the hallway when they allegedly went into an apartment without consent or a search warrant. the video was shown b

the middle of the night in a wal-mart parking lot. kiet do reports. reporter: with a runny nose and a bewildered look, store employees called the toddler their wal-mart baby. a store manager found the 2- year-old wandering the parking lot barefoot wearing just a diaper and t-shirt, at 3 a.m. very friendly, he was it was a warm evening so it wasn t cold. we got storm clothes for him. he wasn t injured. reporter: by 6 a.m. the boy s mother had frantically called 911. that s when police started piecing together what happened. investigators say the boy and his mother live on a first floor unit at the archstone apartments across the street. the special handicapped- friendly door handled unlocks and opens the door at the same time. at three feet tall and 35 pounds, he was apparently tall enough and strong enough to do it himself. investigators say the boy, very likely, walked across owens drive, which is a busy six-lane thoroughfare in pleasanton. there was no traffic at the
