(JURIST) – Congressman Louie Gohmert and a group of Republican electors from Arizona filed a lawsuit on Sunday in the US District Court for the Eastern District of Texas, arguing that the Electoral Count Act is unconstitutional.
The complaint asserts that the Electoral Count Acts dispute resolution provisions violate the Electors Clause and the Twelfth Amendment of the US Constitution. The complaint first claims that the Electoral Count Act directs Vice President Michael Pence to count electoral votes for a State that have been appointed in violation of the Electors Clause. As a consequence, the Electoral Count Act restricts Pences exclusive authority under the Twelfth Amendment to determine which slates of electors may be counted. John Thune, the Senate Minority Whip, made a point of completely smacking down efforts by some Republicans to overturn the election results with a colorful remark.

Have we reached the point where it is not major news when our president mulls a proposal to declare martial law and use the army to override American democracy? Perhaps Donald Trump’s cogitations are now deemed too unhinged to take seriously. Yet for the last four years his bizarre, reality-free tweets have been deemed newsworthy.

“Morning Joe” viewers on Tuesday couldn’t help wondering if actor Sean Penn thought his segment on the show was “audio only” after catching a glimpse of his unkempt, just-out-of-bed “homeless” appearance. While Penn’s background was tidy enough, his hair sprang at all angles out from his head and his shirt was wrinkled.
Cable news morning shows typically run from 6 a.m. ET to 9 a.m. ET and Penn was on MSNBC around 8:30 a.m. ET to discuss his nonprofit, CORE, which is working to provide free COVID-19 tests around Los Angeles and elsewhere in the United States.
