On December 17, 2021, the Sixth Circuit Court of Appeals dissolved the stay of the OSHA COVID-19 ETS. Shortly thereafter, OSHA posted new compliance dates on its website, requiring covered employers to comply with the provisions of the ETS by January 10, 2022.
The Sixth Circuit vacated the stay of OSHA’s vaccine mandate on Friday evening, allowing OSHA to move enforce its regulation of the emergency temporary standard. Today, however, OSHA delayed implementation of the emergency temporary standard until January 10.
