bill: was spencer going to resign anyway, sir? i have no idea. as gallagher s legal team, most of our information about this we were getting from the media same as everybody else. so i really don t know. he said he would, he said he wouldn t. bill: you ve been on the case 7 or 8 months. gallagher retires, keeps his trident. investigation is over. is that the summation of this case? i hope not. i really hope not. because as much as my primary responsibility was to get him home with his full pension and not be in jail, eddie gallagher and i both believe this case has exposed so many problems in the military justice system that i hope that the investigation continues. we did file bill: what do you want specifically? what does eddie gallagher want next if the case isn t over? obviously we want him to go quietly into retirement but want the inspector general to
for a commander-in-chief to exercise his authority when he senses there is something not right in terms of the prosecution of particular case or something that is contributing to a degree of unfairness. but i also will tell you that i ve seen this military justice system up close, operated in it for almost 40 years. i think it is a good system. if you re innocent you want to be in this system. bill: here is eddie gallagher sunday morning. listen to this. both of these seal officers testified for me during the trial and calling they called them out for lying and they re being retaliated against by the command because they re going against the grain. bill: the point the attorney was making this has exposed a lot of problems in the military justice system. has it? well, i think it exposed problems associated with this particular case and certainly
come in and figure out exactly everything that went wrong in this case and take corrective action so nobody else has to suffer what eddie gallagher suffered. we want to make the navy better for this and make the seal teams stronger so this side show doesn t happen again. bill: how did the navy get it so wrong? what was going on on the inside? a failed investigation. they didn t interview half the witnesses there. they didn t consult with the medical examiner. once the prosecutors got involved. they saw it as a career move and he violated every ethical rule out there to try and get his conviction. and facts were not as important as getting that conviction. he was ultimately fired from the case. he should be facing disciplinary charges. the navy doesn t seem to be taking any accountability from him, investigators or anybody else.
analyst and good morning and the question to you then did they get this right in the end, general? well, i think secretary esper didn t have much choice. what actually took place here secretary spencer of the navy, secretary esper of defense were both sporting the administration review that the seal leadership was conducting whether eddie gallagher should maintain his seal pin even though he is going into retirement. the white house was taking objections to even the review taking place. then esper excuse me, secretary spencer worked out a deal with the white house, let the review go forward and if it doesn t turn out in the way the president wants he can intervene. he took that action upon himself without discussing it with esper. at that point secretary esper said what s going on here? are you taking action with the white house and not talking to me about it? so he let them go for that. there were other issues here, bill. in terms of an elephant in the
not to support me while i was incarcerated. bill: that s the man, navy seal eddie gallagher accusing military officials retaliating against him after president trump restored his rank. a top official the navy secretary is out. tim parlatore is the attorney for eddie gallagher. good morning to you. a strange twist late last night. what happened? well, it s just the latest chapter in the saga of eddie gallagher. things happen that we just never expect to happen. we are took this thing to trial. the navy tried to do everything they could to put their thumb on the scale of justice. the jury saw through it. after that they continued the retaliation. they banned him from the base. they tried to tell everybody that he was still guilty. they tried to take his trident away, they did that after the president had given him his rank back. so the timing of it was very clear.
