A township was entitled to summary disposition under MCR 2.116(C)(7) after a man was injured when he fell into a manhole during his weekly trash collection, a Michigan Court of Appeals panel has held.
Where a plaintiff was injured when he fell into a manhole in front of 1049 Holbrook Avenue in Waterford Township during his weekly trash collection, the township should have been awarded summary disposition under MCR 2.116(C)(7) (governmental immunity), as (1) the township does not have jurisdiction over Holbrook Avenue and (2) the manhole is not part of the sidewalk that the township has a duty to maintain.
