it was all part of stevens belief that judges had the obligation to be transparent so the public could make up their own mind. so he tied that to the reputation of the court and people s faith in the court. where some might think that a strict interpretation of the law or whatever your interpretation of the law is primary. he had a sense that what people feel about the court was actually particularly important. that s exactly right. it s really interesting to contrast his view with that of chief justice roberts which he did during that interview. he has said the court s institutional legitimacy requires unanimous opinions. stevens took the opposite view. he said the public will have more confidence in the court if every justice is transparent about his or her reasons that. way people can evaluate the decisions on their own merits. that s why he thought it would be important to blow the whistle that the bush v. gore rationale were made up at the last minute.
