the saga. if we put politics aside for a moment, alex, what can we expect from the tournament now that we have a draw? how much of a cloud is hanging over this tournament because of this? i think the tournament itself, the reputation of it has taken a massive hit. already struggling because of the pandemic, not alone in terms of sporting context for that. but because australia is so isolated for the rest of the world. we had controversy in the event last year when tennis players did come over at a time when even australian citizens couldn t get back into their own country and started playing matches without any spectators at all to start with for the first five days or so of the tournament. here we are with no serena williams, roger federer, you have rafa nadal in the draw but novack djokovic was clearly the biggest headline act until this saga drew up. he s drawn against a fellow
lost. his visa cancellation stands. he ll not be allowed to play in the australian open. that s what that means. his appeal to this court today although you heard the judge say technically it s not an appeal, what they call judicial review. what he wants is the minister decision to cancel his vote visa to be overturned, the court has ruled that will not happen. as you heard the judge explaining there this is not about the merits of the decision in the first place. this is just considering the nature of that decision in line with australian law on the grounds that were argued by djokovic s lawyers. the three judges hearing this court were not convinced by those arguments. it was a unanimous decision. novack djokovic does not still does not have a visa to remain lawfully in australia. that means he ll remain in mandatory detention. that means he ll be removed from the country at a time to be
play, and there is an election not too far off in australia. it could be argued that the government s actions, both the confusion over the visa and the subsequent court actions, have fired things up as well. yeah, they really have changed their argument considerably from the first round of appeals when it was all about the paperwork that djokovic had. the right kind of exemption. was he ticking the right boxes? the grounds they re arguing are now ideological that djokovic could be a corrosive influence in society, his anti-vax views could in some ways spur the anti-vax movement to greater attraction among the community. anti-vax is not especially common in australia, especially compared to america, let s say, but it is a austsmall, strong community that s embraced djokovic as an icon. those are the arguments the government was making that this guy s influence here as a champion really could sow a lot of support for this movement
hystericily in different languages and was also at times being apologetic saying i m not a criminal and then becoming cl completely hysterical. the suspect also claimed to have a bomb at one point. the fbi continues to negotiate with him. we will keep a very, very close eye on this and get back to it in just a moment. but i do want to go now to another breaking story out of australia tonight. his legal team has wrapped up its side of the argument advocating djokovic be allowed to stay in melbourne and play in the open this week, and now the australian government is having its turn. our phil black is in melbourne. phil, good morning to you there. it s almost noon, and you ve got the country s immigration minister saying that djokovic is a, quote, hero to ant vaccination groups and that s a big driver of why they re making the case he needs to leave the country. reporter: that s right, poppy. so the government s lawyer has
