When first introduced in the early 1980s, salmon farms were regulated by the federal government because they existed in the ocean, a federal jurisdiction. However, a legal opinion sought by Fisheries and Oceans Canada (DFO) in 1984 raised questions about the constitutionality of privatizing ocean spaces and fisheries, so salmon farms were transferred to the provinces to regulate as farms.
