Detaining patients illegal, court declares

A patient has no obligation to pay a hospital for the period he or she is detained for failing to foot a medical bill.
The declaration was made by High Court judge Weldon Korir in a case filed by Emma Muthoni against Nairobi Women’s Hospital for detaining her over Sh1.7 million bill.
Ms Muthoni spent two months at the city hospital and her bill was Sh3 million. At the time she was discharged on May 14, 2018, the bill had shot to Sh4 million.

Justice Grace Mumbi Ngugi, a judge of the high court, currently serving in the Anti-corruption and Economic Crimes Division of the High Court is set to receive the coveted Global Jurist of the Year Award on February 16.
Through a webinar organized by the Northwestern Pritzker School of Law’s Center for International Human Rights (CIHR), Justice Mumbi will also be interviewed by the Honorable Ann Williams, retired U.S. Circuit Judge, about the her (Mumbi’s) life-long commitment to human rights, marginalized populations, and diversity, equity and inclusion.

The Judiciary has been thrown into a crisis after a judge temporarily stopped Deputy Chief Justice Philomena Mwilu from holding office.
In an unprecedented move, Meru High Court Judge Patrick Otieno ordered Justice Mwilu to step aside pending determination of a suit filed by Mwongela Isaiah Mbiti.
“A conservatory order be and is hereby issued restraining Justice Mwilu’s continued occupation of the office of the DCJ, judge of the Supreme Court, member of the Judicial Service Commission and Judiciary Ombudsperson pending determination of the suit,” ruled Justice Otieno.

The trial of Nairobi Governor Mike Mbuvi Sonko is underway in the Senate.
The motion to impeach him at the county assembly was moved by Minority Leader Michael Ogada earlier this month and the assembly found him guilty of failing to approve a Sh37.4 billion budget to facilitate operations undertaken by the Nairobi Metropolitan Services (NMS).
Earlier this month, 88 of 122 MCAs voted to remove Sonko from office, on grounds of;
i) Gross Violation of the Constitution or any other law (the County Governments Act, 2012, the Public Procurement and Disposal Act, 2015 and the Public Finance Management Act, 2012)
