Former cabinet minister Malusi Gigaba is giving testimony at the state capture commission.
He is disputing evidence given by his estranged wife Norma Mngoma earlier on Friday.
Mngoma challenged Gigaba to produce evidence that refutes her allegations that one of the Gupta brothers funded the building of the Gigagba house in KwaZulu- Natal.

A short while ago she made it clear that she wants to be called Ms Mngoma and not Mrs Gigaba. She objected to Depuy Chief Justice Raymond Zondo calling her Mrs Gigaba earlier.

The State Capture Commission has made it clear that former Cabinet minister Malusi Gigaba will not be allowed to hide behind the veil of marital privilege to prevent his estranged wife Nomachule Mngoma from giving damning testimony about his relationship with the Guptas.
Deputy Chief Justice Raymond Zondo, without saying a lot, conveyed a message that those required to turn up at the commission can run from accountability, but can t hide their wrong deeds or their complicity to corruption and state capture.

Former minister Malusi Gigaba has failed to convince the commission of inquiry into state capture to dismiss his estranged wife Nomachule from giving testimony.

His lawyer Richard Solomon argued that Gigaba should be protected by marital privilege.
He added that the couple s acrimonious divorce and Nomachule s unwillingness to testify make her an unreliable witness. What we are saying is that there is spousal testimonial privilege and in that context, the non-compellability argument that we ve raised should apply. Where you have Mrs Gigaba who now appears to be a reluctant witness is no longer a voluntary participant in the commission s proceedings, we say that in terms of section 3(4) of the Act, she should not and cannot be compelled to testify because all the protections that one would normally have, are no longer there, said Solomon.
