Joseph Bartulis Jr., a labor and employment attorney at Fletcher Tilton, and a lead negotiator for employers in the public sector, said a lengthy strike is not uncommon. If employees have been out of work for two months, it makes them eager to get back to work and makes their employer want them to come back quickly.
Bartulis said one party will have the desire to resolve matters more quickly. If management is more eager to get employees back to work, they may be more willing to make concessions to settle the contract.
The opposite may also be true as employees who have been out of work and on strike for an extended period of time may be more willing to reduce their demands and settle on a lesser deal than originally proposed.
