The Bloemfontein high court on Thursday dismissed the National Prosecuting Authority’s (NPA) application for leave to appeal the judgment which acquitted the accused in the Nulane state capture case.
The NPA argued in the Bloemfontein high court on Friday that an acting judge in the first state capture case misapplied the law in rejecting the bulk of the evidence presented.
The NPA's Investigating Directorate believes that acting Judge Nompumelelo Gusha erred in her judgment by granting Section 174 discharges to all but one of the accused in the R24.9 million Nulane case.
