Lake County Council prevails in legal battle with commissioners over control of purchasing, data processing

CROWN POINT — The seven-member Lake County Council is entitled to control the county s purchasing and data processing departments, not the three-member Board of County Commissioners that has managed both those departments for decades. That s the ruling issued Friday by Lake Superior Judge John Sedia in the unprecedented lawsuit concerning the rightful separation of powers between the county s legislative branch (council) and its executive (commissioners). In his 10-page order, Sedia said a 1981 Indiana law expressly assigns authority over purchasing and data processing to the Lake County Council, regardless of whether the council has chosen to exercise that authority in the years since.

CROWN POINT — The Lake County Council will not jump the gun and establish a purchasing agent for the sheriff s department until its legal dispute with the Lake County Commissioners over control of county government purchasing is resolved. Sheriff Oscar Martinez Jr. asked the seven-member council to speed up its takeover of county purchasing because he said the continuing refusal by the three commissioners to consent to all his purchase requests is endangering officer and public safety in Lake County. Martinez specifically cited his department s need for blue light technology used to detect blood and other bodily fluids at crime scenes, vehicle antennas that connect to satellite internet service, and a new boat for Lake Michigan water rescues.
