testimony fully justified the subpoena to trump white house counsel pat cipollone that the committee issued today. the last time a president was destroyed by a congressional investigation, the white house counsel was a key witness. richard nixon s white house counsel, john dean, helped bring down the nixon presidency, with his testimony in the watergate hearings. and now it looks like pat cipollone could be the witness who locks in donald trump s guilt for the january 6th committee. when presidents break the law, the white house counsel knows. the white house counsel s job is to prevent presidents from breaking the law, among other things. that is to say, prevent them from breaking the law intentionally or, as can happen, unintentionally. when someone in the white house has a bright idea, like banning all muslims from entering the country, it is the white house counsel s job to say, we can t do that, that s unconstitutional. the white house counsel is not the president s pers
showing irreparable harm. as andy weisman correctly pointed out, the only irreparable harm is it to the united states of america, and the department of justice and having to slow anything down. and show anything to the special master. because in an ordinary case, he wouldn t need or have a special master. he would simply have the court that ordered the lore warrants, issued the search, there s no claim that the search was illegal there s no claim that the president actually did anything to declassify the documents despite his claim that he did it by some telepathic process. a claim that he makes only out of court, but not in court. so it s really quite clear that the path is open for going forward. you ve known merrick garland since he was one of your law students, and i know you ve read that atlantic piece today,
that can stand up in a court of law. and so i think that is a very difficult case for the justice department to bring. but the mar-a-lago case, i think it s much more black and white. and it relates to a very core principle that merrick garland is just a central to merrick garland. it s the rule of law. that there is nobody in this country who stands above the law. who s immune from the law. and so i think that this case, which is so, so much clearer! at least it seems from the outside and the principle at stake, it s so central to the way that garland thinks about the fabric of our democratic institutions i think it is inevitable that he brings and indictments here. all right, franklin foer we will be catching up with you in the coming weeks, months, and we know this all have the come to pass before a new president is installed, and there. we franklin foer stuff at the atlantic, writer it s great to see you frank. great to see you, thank you. that does it for us tonight,
