Aeon BiG: Federal Court dismissed Mega Continental s leave application to appeal

18 May 2021 / 00:22 H. PETALING JAYA: Aeon BiG (M) Sdn Bhd said the Federal Court had dismissed Mega Continental Sdn Bhd’s leave application to appeal to the Federal Court on April 20, 2021. In a statement, Aeon BiG said it had obtained the Penang High Court declaration order on Nov 8, 2019 which was subsequently upheld by the Court of Appeal on Dec 11, 2020. The declaration order stated that the agreement to lease, signed between Aeon BiG and Mega Continental for the property located at Bandar Alor Star was a monthly tenancy instead of a 10-year lease as the state authority did not grant their consent under Section 433B of the National Land Code 1965 within the required conditional precedent period under the agreement.

AEON BiG (M) Sdn Bhd said today Malaysia's Federal Court on April 20, 2021 dismissed Mega Continental Sdn Bhd's leave application to appeal against the Court of Appeal's decision to uphold the Penang High Court's ruling in a lawsuit initiated by hypermarket operator AEON BiG against Mega Continental involving the lease of a property in Bandar Alor Setar, Kedah.

PUTRAJAYA: The Court of Appeal has dismissed Mega Continental Sdn Bhd’s appeal against the Penang High Court judgment on Nov 8,2019, that an agreement to lease was a monthly tenancy as the state authority did not grant consent under Section 433B of the National Land Code 1965, according to Aeon Big. “In this case, the termination of the agreement to lease for Aeon Big Alor Setar store is lawful according to the agreement to lease, ” Aeon Big said in a statement Saturday (Dec 12). The statement said that in August 2020, the Alor Setar High Court set aside the judgment in default obtained by Mega Continental Sdn Bhd on June 9,2020, where the company claimed from Aeon BiG a judgment sum of RM142mil.

Appeals court upholds judgment in favour of AEON BiG in Alor Setar tenancy case

KUALA LUMPUR (Dec 11): The Court of Appeal has upheld the High Court’s decision that the termination of the lease agreement for an AEON BiG store in Alor Setar was lawful. AEON BiG (M) Sdn Bhd, in a statement today, said the appeals court dismissed landlord Mega Continental Sdn Bhd’s appeal against the November 2019 judgment of the High Court in Penang. Mega Continental, a unit of Penang-based Belleview Group, had sued AEON BiG for RM142 million for allegedly failing to perform its obligation under the lease agreement after it vacated the store ahead of the expiry of the lease.
