The Metropolitan Waterworks and Sewerage System-Regulatory Office (MWSS-RO) is still clarifying with the government panel that revised concession agreements between MWSS and water concessionaires if the foreign currency differential adjustments (FCDA) can still be implemented for the third quarter this year.
In a text exchange, MWSS Chief Regulator Patrick Ty said it is not yet clear whether or not the FCDA adjustments for the third quarter and fourth quarter of this year can still be applied amid the issuance of the revised CAs (RCA) between the government and its two concessionaires, Maynilad Water Services Inc. and Manila Water Company, Inc.

Negotiation on a new water concession agreement (CA) between the government and Maynilad Water Services, Inc. “was smooth and easy,” Justice Secretary Menardo I. Guevarra said on Tuesday, May 4.
“Except for a few matters pertaining to Maynilad’s business plan, JICA (Japan International Cooperation Agency) loans, and public listing of shares, the parties are in agreement on the rest of the proposed new concession agreement with Maynilad, which takes off from a similar concession agreement with Manila Water” (Manila Water Company, Inc.), Guevarra said.
The meeting between representatives of the government and those of Maynilad Water’s was held last Monday, May 3.

Justice Secretary Menardo I. Guevarra on Sunday, May 2, assured there will be no more onerous provisions in the new concession agreement (CA) that will be signed with Maynilad Water Services, Inc. (Maynilad Water).
“There are certain provisions which, I believe, are non-negotiable,” Guevarra stressed.
“The removal of the non-interference clause, the non-chargeability of corporate income tax to consumers’ water bills, no government guarantees for future debts, COA (Commission on Audit) audit, and a more transparent governance mechanism are some of these,” he said.
The assurance was made by Guevarra as representatives of Maynilad Water and the government are set to start their talks on Monday, May 3, on the new water concession agreement.
