The 3rd Circuit Court of Appeals, in a precedential ruling, has upheld a decision by a U.S. District judge in Johnstown who imposed an enhanced sentence on a Cambria County man charged with possession of child pornography.
Federal District Judge Kim R. Gibson in 2008 sentenced Maximus Prophet, also known as Mark L. Ferrari, to 14 years of confinement followed by 15 years of supervision after he pleaded guilty to multiple counts of possession of materials depicting the sexual exploitation of a minor.
The sentence included a two-level enhancement because the material was stored on a peer-to-peer network that could be accessed by Prophet and others.
