DTI asserts authority on safeguard measure

Published January 4, 2021, 5:00 AM The Department of Trade and Industry (DTI) has stood its ground stating it does not need the concurrence from the Tariff Commission (TC) to adjust a safeguard duty rate on a particular import that has been causing injury or serious threat to a domestic industry. This was stated by Bureau of Import Services (BIS) Director Luis Catibayan when asked on the different stand by the TC over a decision by DTI Secretary Ramon M. Lopez to adjust the safeguard duty on the second year of the three-year definitive safeguard measure on imported cement. MB File Catibayan stressed that it is the “discretion of the DTI Secretary” and that the “DTI Secretary has the power to determine” the safeguard duty rate.

DTI, TC differ over cement safeguard duty

Published December 21, 2020, 7:00 AM There appears to be confusion in the imposition of the second year safeguard duty on imported cement with the Department of Trade and Industry (DTI), the Tariff Commission (TC), and the Bureau of Customs (BOC) apparently not coordinating with each other. This transpired at the recent public hearing last Friday by the TC on the Monitoring of the Philippine Cement Industry.                 The DTI already issued Department Administrative Order No. 20-08 series of 2020 setting the duty rate for the second year of the three-year safeguard measure against imported cement at P9.80 duty for every 40-kg bag of imported cement or P245 per metric ton.
