5 hours ago Magistrate Judge Andrew Rodovich of the Northern District of Indiana on Wednesday denied a motion to dismiss a case against a physician and the Centers for Pain Control Inc. (CPC), finding that the relator’s claims hold up to the required pleading standard.
Physician Dion Snider filed a qui tam action in May 2018 alleging that the defendants were operating a fraudulent billing and kickback scheme, in violation of the FCA, the Indiana False Claims and Whistleblower Protection Act, and the federal anti-kickback statute. Snider claimed that CPC promised and gave out free massage therapy sessions to Medicare and Medicaid patients who purchased trigger point therapy and failed to bill the federal health programs for the massage therapy sessions.
Northwest Indiana man faces possible Washington trial

HAMMOND, Ind. A Northwest Indiana man charged with participating in the Jan. 6 riot at the U.S. Capitol could face trial in Washington on misdemeanor counts.
Kash Lee Kelly, 32, of Hammond, appeared Thursday before a federal magistrate to face charges of illegal entry into a restricted federal building and violent entry and disorderly conduct on Capitol grounds. He could face more than six months in prison if convicted, The (Northwest Indiana) Times reported.
Kelly has been in federal detention since his arrest last week in Indiana.
U.S. District Magistrate Judge Andrew Rodovich said he would order Kelly returned to Washington after Kelly is sentenced next month on federal drug conspiracy charges that pre-date the Jan. 6 riot.
