Law allows you to sue government for dangerous roads, accidents May 30th 2021 at 18:00:00 GMT +0300
A court recently ordered the Kenya National Highways Authority (KenHa) to pay lawyer Ahmednasir Abdullahi Sh750,311 for damages that occurred on his Bentley Bentyaga while driving on a key road under repair.
In his suit, Senior Counsel Abdullahi argued that the workers failed to put up appropriate signs warning motorists of danger on the stretch of the highway that was being re-carpeted. Shrapnel hit and shattered the windscreen of his high-end car at a section of the Nairobi – Namanga highway on August 25, 2018.
Senior Magistrate Edwin Mulochi found KenHa guilty of negligence and ordered that it compensates the Senior Counsel for the damages.
New Twist In Ahmednasir’s Bid To Auction 3 Govt Vehicles Over Bentley Windscreen Damage
A court has stopped Senior Counsel Ahmednasir Abdullahi from auctioning three government vehicles to recover Sh750,000 awarded to him as compensation for damage caused to his luxurious Bentley Bentayga.
The no-nonsense lawyer, otherwise known as Grand Mullah, seized the vehicles from the Kenya National Highways Authority (KeNHA) last year. This after the State-run roads agency failed to pay the money awarded to him in a court ruling on August 2020.
In the ruling, Magistrate Edwin Mulochi found KeNHA liable for the damage caused to Ahmednasir’s luxury SUV after stones and shrapnel from road repairs hit the windscreen on the Nairobi-Namanga highway in August of 2018.
