The Court lamented the amount of judicial time that was being spent on such cases, as no political party is willing to insulate the police from executive interference.
Since the ruling is prospective, cases that have already been transferred to family courts by previous orders of the High Court will not be sent back, the Full Bench said.
As per NCRB data, in 2021, Tamil Nadu reported 1,775 detenues under preventive detention laws, which accounted for 51.2 percent of the total cases across the country, the Court was shocked to note.
