In a significant judgement that will ease the pains of many senior citizens, the Bombay High Court has ruled that a son cannot claim any right of share in his parent s flat while they are alive.
The Court noted that there was no specific provision that dealt with the issue of guardianship of a disabled person and hence decided to deal with the father on the same footing as a minor who holds a share in immovable property.
The Bombay High Court on Saturday observed that a son cannot have a right, title or interest in the flats owned by his parents as long as they are alive.
