Graham installed three new attenuation tanks at the dock as part of the port’s drainage strategy to collect surface water prior to its discharge. To enable the installation of the attenuation tanks, three 70m long, 10m wide and 7m deep excavations were required. Mabey Hire was contracted to design and supply the groundworks equipment for the project.

The UK firms supply excavation groundworks products to some of the nation’s largest construction companies for projects such as housing developments, roadworks, railway line works and water pipe upgrades. A third groundworks company, Mabey Hire, took part in the collusion for five months but has not been fined as the firm brought the illegal activity to the CMA’s attention and has co-operated with the investigation.

The Competition and Markets Authority (CMA) said VP and MGF (Trench Construction Systems) shared confidential information on upcoming pricing and commercial strategy. A statement from the watchdog added that the firms coordinated their commercial activities, monitoring each other’s prices and challenging quotes they thought were too low. The CMA said its investigation found that the collusion lasted almost two years. They were alerted by a third company, Mabey Hire, which acted as part of the cartel for five months. Mabey has not been fined because it reported the activity to the CMA and cooperated fully with the investigation, the statement added.

(Trench Construction Systems) Ltd, have been fined more than £11.2m and £3.7m, respectively. The CMA found that the companies colluded illegally to reduce competition and maintain or increase prices. This involved sharing confidential information on future pricing and commercial strategy. They also coordinated their commercial activities to reduce uncertainty, including monitoring each other’s prices and challenging quotes they deemed too low.
