Council appeals for orders to strengthen earthquake-prone Adelaide and Toomath s buildings

Both are considered heritage buildings. A Wellington District Court judge refused to make an order that the council could undertake unspecified seismic strengthening. He said the council should get an order to enter the buildings so plans could be prepared, and then subsequent orders to do the work. The council also had the option to demolish the building. The building owner would ultimately pay for the work, or the building could be sold to meet the costs. The council appealed against the District Court decision. Whittington told Justice Rebecca Ellis​ at the High Court in Wellington on Monday that the process the District Court favoured would duplicate, or even triplicate, the hoops the council had to jump through.

AA Ltd. said in an April 14 High Court filing that it had not signed an agreement to use Fenchurch Advisory Partners LLP, so it doesn t have to pay £4 million for any work completed by the firm in 2019. The AA said that it approached Fenchurch in early 2019 to act as a financial adviser for a potential sale.

Wellington council appeals against Adelaide Hotel strengthening decision

The owner of the building Lakhi Maa​ Ltd opposed the council’s application. Despite repeated notices requiring earthquake strengthening since 2006, the only work done was to strengthen unreinforced masonry in the facade, the district court said. Lakhi Maa Ltd acquired the building in late 2015. It had wanted to redevelop the site as a hotel, but after the council’s strengthening application was filed the company asked for resource consent to demolish the building. In a decision in December the District Court judge, Chris Tuohy​, said the fundamental issue against the council was whether it should be given permission to strengthen the building without specific plans for the work.
