it is prosecutors not the line agents who decide whether or not there is a case this is not hunter story this is joe biden story. the house can follow think the pressure on. i benson is in this and the washington post to pressure the u.s. attorney in delaware, david weiss said will make the final decision bringing charges against the president son. perhaps i don t know what the motive of who the leaker is or who they are there s three different sources cited in the story i found it a bit amusing to see the protest on the left about the story that are so inappropriate the leaks and were getting close to an election we had so many d.o.j. and fbi about a certain former president for example, a drumbeat for years in a big bombshell and now all of a sudden some of them say this is wildly inappropriate i think it s a little bit hard to take seriously. you kind of engaged, my
agents investigating hunter gathered what they believe is sufficient evidence to charge him with tax crimes for a gun purchase, according to people familiar with the case. a story would appear significant because it involves a open investigation of the president s son. the post cites people familiar with the case. plumlee more than one source the post finds credible on this issue. this is a decision that will be up to the justice department, and yet the story, it s important to note, seems to draw on what sound like what federal agents believe. there have been other cases where we ve seen agents providing information that somehow gets out to the public about what they believe should happen. of course, you have to remember when you look at doj cases, it is prosecutors, not line agents, who decide whether or not there s a case. also, we want to bring you the response to this big story from hunter biden s lawyer to notes the a felony for an agent to
act and by the way, most boxes are packed by staff, not by the president. absolutely. robert, real quick, merrick garland took to the podium and said he knew of this and approved it. the raiding of a home of a former president, would that not raise to the level of awareness of joe biden? would not the president know that? very, very good question. when something is this politically sensitive, and it wouldn t matter what administration or what prior president, if something were this sensitive, you have to believe it was pushed to the very top. by the way, this is no fault of the line agents. this is no fault of the fbi s line agents. i think people need to understand that. this was a political act. it bothers me enormously because the fourth amendment looks to me presumptively to be violated. unless you find something absolutely extraordinary, there s a lot to be answering for. robert charles, extent information and perspective this morning. thank you for joining us on fox
federal records act or could be subject to a freedom of information act request, an employer request i would have vetoed such a plan. we can t delete or eliminate messages, communications, documents, that are subject to those two laws. i don t know all the facts about what happened in 2021 or dod or dhs, but it s very troubling. i do have some sympathy, ana, for the line agents on front lines of the secret service. they were in the midst of a presidential transition managing the security around the inauguration. in just a couple of weeks the nation was on high alert after january 6th, so frankly with that large mission in front of them it s not surprising to me that the agents on the front line, and i used to be their protectee as well as their oversight. it s not surprising to me that the agents on the front line may not have gotten this data
also very important is we did see some inexplicable behavior by fbi s leadership. they lied to their own line agents about where this information came from. i disagree a bit with andy. i don t think they had to show all elements of the fiber with misled as to the source of this. but i do think that they showed that it was material. that the idea that the line agents didn t say where did this come from and they were duped by their supervisors and the leadership of the fbi as to where it came from. they kept it secret. that shows some disturbing behavior and casts questions on the motivations of the fbi leadership. the next trial with dan schenko
