During the organizational meeting of the Exploratory and Investigative Committee on May 3, questions were raised about its legal power after Ayers Ratliff, D-2nd Ward, said he would like to issue subpoenas and have people testify under oath. In response to this, Law Director Mark Russell, in a written statement, said Ohio Law and Marion City Code both state they do have these authorities. In his response, Russell cited the Court of Appeals, which stated City Council has inherent power to make full and complete investigations into issues regardless if they will become future legislation or not. He added these authorities give Council the power to investigate all departments of city government which includes the City Auditor s Office.
