The District Attorney s Office has determined that county Legislator Ernest Flagler-Mitchell did not commit a crime when he messaged an explicit photo to a 19-year-old city woman.
The DA s Office has, however, forwarded information it gathered to the county Board of Ethics, which is investigating Flagler-Mitchell.
The three-member Board of Ethics also has contracted with local lawyer David Rothenberg to conduct an investigation into Flagler-Mitchell. Rothenberg declined to comment Monday.
County records show that the Board of Ethics voted in March to contract with Rothenberg s firm of Rothenberg and Rothenberg.
Lakaya Sinclair, the young woman who received the explicit photo from Flagler-Mitchell, said Monday that she has talked to Rothenberg, but has heard nothing else about the county ethics investigation. She said she is frustrated by the pace of the investigation and the lack of information she has received.

Flagler-Mitchell was installed as the chapter president in a ceremony on Jan. 16, about two hours before news broke that he had been accused of sexual harassment by sending a sexually explicit photo, and other suggestive text messages, to a 19-year-old woman. The Democratic legislator, who is 42 and married with eight children, has since acknowledged sending a sexually explicit photo to the woman, Lakaya Sinclair, who is now 20, and has explained that the photo was meant for his wife.

Monroe County Legislature President Dr. Joe Carbone says he supports an independent investigation by the legislature into the conduct of Legislator Ernest Flagler-Mitchell. Carbone says that s as long as this third investigation would not interfere with investigations by the County Ethics Committee and the Monroe County District Attorney.
Carbone said those entities need space to do their job and conduct thorough and impartial investigations. He says their investigations should be completed first.
Flagler-Mitchell is accused by 19-year-old Lakaya Sinclair of sending a sexually-explicit picture to her phone. He says he intended it for his wife and sent it to the wrong number.
