Lying or not, juror gives Chauvin attorneys appeal opportunity

A juror who helped convict ex-police officer Derek Chauvin has given defense attorneys an opportunity to win a mistrial if they can convince the court the juror lied before being seated, says a former prosecutor. The question that Chauvin s attorney is going to attempt to demonstrate is that this juror lied, Abraham Hamilton III, a former assistant district attorney, says of the revelation that Brandon Mitchell attended a Washington, D.C. protest march in August 2020.
“The opportunity to go to D.C., the opportunity to be around thousands and thousands of black people,” Mitchell told reporters, “I just thought it was a good opportunity to be a part of something.

Derek Chauvin’s legal team has just filed for a new trial in his case. Chauvin was convicted on April 20 of three counts in the death of George Floyd – second-degree murder, third-degree murder, and second-degree manslaughter.
His attorney, Eric Nelson, is alleging multiple grounds for the new trial, including jury misconduct.
In the filing, Chauvin’s attorney says the former officer should have a new trial in the “interests of justice; abuse of discretion that deprived the Defendant of a fair trial; prosecutorial and jury misconduct; errors of law at trial; and a verdict that is contrary to law.”

Brandon Mitchell, a member of the jury that convicted former Minneapolis police officer Derek Chauvin for the murder of George Floyd last month, is under scrutiny for photos that surfaced of him that seem to contradict what Mitchell reported during jury selection for the trial.
Before being seated to serve on the jury, those called for duty completed a lengthy questionnaire that, among other things, asked respondents whether they had participated in demonstrations in response to George Floyd s death.
