PHC stops KPRA from claiming liabilities Peshawar February 11, 2021 PESHAWAR: A division bench of the Peshawar High Court (PHC) has stopped Khyber Pakhtunkhwa Revenue Authority (KPRA) from claiming liabilities from Souvenir Tobacco Company Limited till further orders. The PHC bench comprising Justice Syed Arshad Ali and Justice Naeem Anwar issued notices to the Advocate General, KPRA director-general and KP chief secretary to submit their comments. The counsel for the petitioner Qazi Ghulam Dastagir argued that the point of origination of the company was outside Khyber Pakhtunkhwa province, therefore the authority had no jurisdiction to term the company as a withholding agent.

This move was part of the newly introduced Khyber-Pakhtunkhwa Amendment of Certain Fiscal Laws Bill, 2021 in the provincial assembly. According to the bill, all those buildings that are being used by government, semi government, non-governmental organisations, financial institutions, private commercial organisations - local or international brand shops, foodchains, outlets, wedding halls, hotels and restaurants - guest houses, hostels or banks shall now be assessed and taxed under the rates and procedures mentioned in the Khyber-Pakhtunkhwa Finance Act
