Malawi’s graft bustling body, Anti-Corruption Bureau (ACB) wants to break free and be independent from political interference and relieved of the legal requirement that entails them to seek consent from the office of the Director of the Public Prosecutions (DPP) to prosecute cases.
Recently, ACB conducted interviews to hire a new head after its former boss’s contract expired and Ombudsman Martha Chizuma is tipped to become the next ACB director after she emerged tops from a group of more than 10 men.
In search for total freedom, the corruption-fighting body, ACB, has written the Ministry of Justice and Constitutional Affairs to start a process that would see an amendment of the Corrupt Practices Act which, among other things, be removed could see the removal of that requirement of seeking consent from the DPP to prosecute cases.
The High Court in Blantyre has adjourned a case in which former president Peter Mutharika and former top civil servant Lloyd Muhara are asking for the suspension of K69 million court costs they were ordered to pay.
Mutharika: Ordered to pay costs
The Registrar of the High Court Antony Kapaswitchi has adjourned the case to April 15, 2021.
Mutharika and Muhara were found guilty of interfering with judiciary operations when they ordered Chief Justice Andrew Nyirenda and another senior judge to proceed on forced leave.
Lawyer for the two, Mwayi Banda, said their basic argument is to allow the court to first hear the review of the matter scheduled on April 26, before proceeding with the enforcement of the matter.

A high-profile cost determination case involving former president Peter Mutharika and former secretary to the Office of the President and Cabinet Llyod Muhara has failed to take off as scheduled in the High Court in Lilongwe today.
Muhara: Case adjourned
In November last year, the High Court ordered the two to pay costs incurred in a case in which they were found guilty for ordering Chief Justice Andrew Nyirenda and Justice of Appeal Edward Twea to proceed on leave pending retirement.
The High Court was Tuesday morning set to hear submissions from both sides on the costs to be paid by Mutharika and Muhara.
