ENID, Okla. â Ben Ezzell has suggested the state may be facing âan issue of first impressionâ regarding recall elections throughout Oklahoma in his appeal of the petition for his recall as city commissioner.
In his brief in chief filed last Thursday, Ezzell argues that the state Supreme Court therefore has the opportunity to apply the same standard of review as a question of law for recall petitions as it has done before for other petitions.
Ezzell provided two main arguments in his brief: His first that the district court in its ruling erred finding the petition sufficient because it failed to include explicit arguments of âtruthfulness,â as required by the Enid City Charter.

Another candidate has filed to run in the February recall against Ward 3 Enid City Commissioner Ben Ezzell.
Enid resident Kent Rorick filed on Wednesday, the last day to file to run in both the recall and the regular elections, both to be held on Feb. 9.
Keith Siragusa also filed in both Enid races Monday at the Garfield County Election Board office.
Ezzell also will run in the recall battle to hold his seat for the remaining three months, after which he will term out of office and the winner of the regular ward election will be sworn in.
All three Enid City Commission ward races â excluding the Ward 3 regular election â will have at least three candidates on the ballot.
