Gov. J.B. Pritzker signed a measure aimed at shoring up sexual assault laws so that charges can be brought in cases where victims became too intoxicated on their own to consent to sexual activity.
The law amends Illinois Criminal Code to specify that someone is unable to give consent when intoxicated, even when the accused assaulter didn’t provide it.
The bill, which passed without opposition this spring, aims to make clear that charges can be brought regardless of how the alleged victim became intoxicated or impaired.
