The State Capture Commission of Inquiry will lay a criminal charge against former South African Airways (SAA) board chairperson, Dudu Myeni.
Myeni was a no-show at the commission on Tuesday, defying a summons to testify.
Her legal representative, advocate Nqabayethu Buthelezi said she had instructed him to apply for a postponement because Myeni did not have all the documents needed for her testimony.
Buthelezi said Myeni had changed legal teams and was not aware that the commission was trying to track her down.
Myeni wanted more time from the commission for her to respond to questions she was asked in her last appearance where she elected not to answer so as not to incriminate herself.
While he was ANC spokesperson, Zizi Kodwa received cash and payments in kind from tech giant EOH amounting to more than R2-million.
This was the upshot of testimony given to the Zondo Commission on Tuesday by ENS Forensics specialist Steven Powell. Powell had previously been tasked by the commission into looking at EOH, its relationship with the ANC and the money and communications flowing between EOH executive Jehan Mackay and Kodwa.
Powell told the commission that a subpoena of Kodwa’s bank accounts had revealed multiple transfers from Mackay, from May 2015 to February 2016. On one such occasion, in February 2016, Mackay deposited R30,000 in Kodwa’s account to take it out of arrears.

It turned out she was on her way to family engagement on Tuesday morning instead.

It looks like former SAA board chairperson Dudu Myeni won’t be appearing before the Commission of Inquiry into Allegations of State Capture on Tuesday.
Myeni was scheduled to testify on matters relating to SAA. However, she has pulled a no-show despite being summoned by the commission.
‘Criminal offence’
Addressing Myeni’s no-show, evidence leader Kate Hofmeyr told commission chairperson Deputy Chief Justice Raymond Zondo it was a criminal offence not to appear before the commission, adding that Myeni abused her privilege to remain silent and not answering some questions during

Former SAA board chairperson Dudu Myeni followed in the footsteps of her close ally, former president Jacob Zuma, and decided to show the state capture inquiry the middle finger on Tuesday.
Myeni was supposed to appear at the inquiry after being served with a summons.
However, like Zuma, Myeni decided to not comply with the summons, instead sending her lawyers led by advocate Nqabayethu Buthelezi to seek a postponement of the hearing of her evidence.
