Mumbai: Bombay HC sits late into night to hear Maharashtra govt s plea seeking to quash CBI FIR against Anil Deshmukh

After sitting for over 12 hours, hearing matters virtually, the Bombay High Court bench of Justices Shahrukh Kathawalla and Surendra Tawade took up for hearing the Maharashtra governmentâs plea seeking to quash certain parts of the CBIâs FIR against former home minister Anil Deshmukh, late on Wednesday night.
The HC was informed by senior counsel Rafique Dada for the State that the CBI was only asked to probe the alleged corruption case but it was now demanding documents pertaining to the stateâs probe against Rashmi Shukla in the phone-tapping case. âThey want to pounce on these documents now. They cannot demand these documents as we are already investigating the case. This would only create confusion in the enquiry,â Dada told the bench.
Kisan petitioned Justice Kathawalla s bench as the collector, Thane and other relevant authorities refused to grant the mandatory approval under the Maharashtra Land Revenue Code, 1966.
Under this code, for a tribal person to sell his land to a non-tribal person, a prior sanction or approval is mandatory from the state authorities to ensure that the purchaser doesn t use the land for agriculture purpose and exploit the poor tribals.
To justify the decision for not granting approval, Adhik Patil, Tahsildar, Thane, in his affidavit stated that the land in question is reserved for playground and that the purchaser Sharma cannot buy the said land. The affidavit further stated that the MMRDA has reserved this land.

MUMBAI: An appeal bench of Bombay high court on Friday directed Bombay Parsee Punchayet (BPP) to allow a Parsee woman, Zuleika Homavazir, to contest its forthcoming polls as her proposer Rustom Jeejeebhoy, who belongs to an illustrious family, is still on its voters list.
The HC bench of Justices Shahrukh Kathawalla and Vinay Joshi said that until the name of Jeejeebhoy appears on the general register and is not struck off, Homavazir was fully justified in submitting her nomination form proposed by him on January 29 and “the trustees have incorrectly rejected” it. The election is for filling up two vacancies on the board of trustees of the BPP.

Mumbai: Bombay high court on Tuesday dismissed a petition by the wife of a doctor who died due to Covid-19, seeking Rs 50 lakh insurance for Covid warriors under Pradhan Mantri Garib Kalyan Package, holding that the scheme was only for private doctors whose services were requisitioned for Covid-19 duties.
The verdict by a bench of Justices Shahrukh Kathawalla and Riyaz Chagla came on a petition by Koparkhairane resident Kiran Surgade. On March 31, 2020, Dr Bhaskar Surgude got a notice from Navi Mumbai Municipal Corporation to open his clinic to treat patients, and was warned of prosecution if he did not. He opened his clinic at Turbhe and treated Covid patients. He got infected and died on June 10.
