representation. that s right. we have chief justice roberts, k kagan, kavanaugh, and gorsuch. ruth bader ginsberg is not there. she s had health problems. she also has not attended the last two state of the union addresses. this will be the third. a lot of supreme court justices don t like being there because they re not allowed to express visible emotion at all. smiling or clapping or sitting pointedly or standing pointedly and it s uncomfortable. so he had a reaction that was covered after president obama said something. but kavanaugh is the one, obviously, that a lot of eyes are on. we saw the congresswoman from new york brought a guest who is of note because she challenged senators to vote against now
finding a way to keep republicans energized by saying there is going to be a fight. don t sit back on your laurels because the the ddems could imp brett kavanaugh. and the judges and supreme court have been something that consistently turn them out in the midterms and all elections. so if the president can say we need you, if you don t vote, he s gone, that could be something that would energize them. and i can tell you that the candidates i cover in texas in the federal race, they have absolutely no appetite to talk about impeachment whether with the president or kavanaugh. this is not something that the democrats want to talk about the on trail. so we ll talk about it though when the president speaks, we ll play that for you right after the break. stick around. duncan just protected his family

what about then the possibility of recusal. this seems to have come up from some of his critics on things like for example executive power. what is the expectation? well, i think the expectation is that he is not going to recuse on political questions. most justices don t. there are some rare exceptions like for example the vote on the nixon tapes, but for the most part supreme court justices don t refrain from voting on cases that involve the presidents who appointed them. for example neil gorsuch voted on some cases that involved durd and other justices that have been appointed by clinton and obama have done the same for issues involving their presidents. most times supreme court justices recuse themselves because of some direct personal conflict. they own stock in a company that is involved in a case, they have a family member that is involved in a company. or they somehow handled a case before it got to the court. but recusal because of a political dispute or criticism for a po
