ISLAMABAD: The Supreme Court (SC) on Thursday set aside the verdict of Peshawar High Court (PHC) declaring unconstitutional the Khyber-Pakhtunkhwa (KP) Civil Servant Amendment Act, 2019 that increased the retirement age of the government servants from 60 to 63 years.
A three-member bench of the apex court, headed by Chief Justice Gulzar Ahmed, heard the petition filed by the government of Khyber Pakhtunkhwa (KP) challenging the PHC verdict. The court after hearing to the parties set aside the PHC verdict and remanded back to high court for deciding the matter afresh and on merit.
Chief Justice Gulzar Ahmed, however, observed that the law cannot be ruled wrong on the reservations of some civil servants. The chief justice noted that it is the government’s job to make the law and the court’s job to enforce them. The CJP remarked that the law is made as per the Constitution and not Rules of Business.

As the novel coronavirus pandemic unfurled, the judiciary found itself at a critical intersection between health and justice.
As efforts to contain the outbreak took precedence, the country’s already high judicial backlog ballooned even further. By November 15, nearly 4,000 more cases were added to the pot of pending judicial business, taking the total backlog to 45,959 cases.
With the second wave showing no sign of subsiding, maintaining full momentum in judicial activity is likely to end up as the judiciary’s biggest challenge going into next year.

JCP approves nomination of Justice Qaiser Rashid Khan as new PHC chief justice
He took the oath as the acting chief justice of PHC on November 16
ISLAMABAD:
The Judicial Commission of Pakistan (JCP) on Wednesday approved the nomination of Justice Qaiser Rashid Khan as the new chief justice of the Peshawar High Court (PHC).
Chief Justice of Pakistan (CJP) Gulzar Ahmed presided the meeting of the JCP to consider a nomination for the post which fell vacant after the death of Justice Waqar Ahmad Seth due to coronavirus earlier in November.
Justice Qaiser Rashid Khan was appointed as an additional judge on August 2, 2011, and he took oath as the acting chief justice of PHC on November 16.
